Right of withdrawal, return of goods

The customer who orders products from the online shop BAM CHOCOLATE (www.bamchocolate.com) may, if he is not satisfied with the products ordered or wishes to withdraw from the contract (purchase) for any reason, notify the Provider (in writing by post or via e-mail: info@bamchocolate.com) within 15 days of receiving the product, without being required to give a reason for his decision. The Buyer must then send the goods to the Provider's address (Moja Čokolada d.o.o., Savska Loka 21, 4000 Kranj, Slovenia) within 15 days of the notice, in unchanged quantity and undamaged. We will return all payments made to the buyer within 14 days of notice, without the buyer having to request it. The refund will be made using the same payment method used for the original transaction.

The buyer must inform the company of the withdrawal from the contract with a form (you can find the form here) or by an unequivocal statement making it clear that he is withdrawing from the contract. The withdrawal declaration must be sent within the time limit set for withdrawal. The notice is considered to be on time if it is sent within the deadline.

The costs incurred in returning the goods shall be paid by the buyer. Returned products should be unused, undamaged and in their original packaging.

Right of withdrawal, return of goods

The Buyer may file a complaint for the goods if the goods do not have the characteristics expressly promised by the Seller, if the Seller has sent the wrong products, in the wrong quantity, colour or that otherwise deviate from the Buyer's order. The Buyer may claim the goods within 15 days of purchase and request immediate replacement with an identical, faultless item or within the statutory time limit and under the conditions for claiming under a material defect.

In the event of a complaint, the Buyer may, subject to legal restrictions, request the replacement of the item, its repair or a refund of the purchase price. In the latter case, the Seller reserves the right to charge a rental fee at the current price list for the time the goods have been used by the Buyer, but not exceeding the amount by which the market value of the goods has decreased during the period of use and as a result of the use.

The Buyer may return the Goods by bringing them in person or by returning them by post at the Buyer's expense and with the Seller's prior agreement. No other method of return is possible at our expense. 

Damaged shipments

In the event that a parcel is physically damaged, missing contents or shows signs of opening, the customer must initiate a complaint procedure with the delivery service we currently use. To do this, please inform us of the incident (via email info@bamchocolate.com) and we will explain the further complaint procedure with the current delivery service. To make a damage claim, you must keep the original packaging and bubble protection (the package in the same condition as you received it, without adding, removing or changing anything) and then prepare a Damage Report with the delivery service. A receipt is also required for the claim. We will work with the delivery service to ensure that the claim is resolved as soon as possible.

• When returning an item to the seller for a claim or warranty, you must enclose a copy of the invoice
• You must request/complete a Damaged Shipment Report with the delivery company. The address for returning goods to the seller is Moja Čokolada d.o.o., Savska Loka 21, 4000 Kranj, Slovenia.
• We recommend that you use a delivery service that allows you to trace the shipment and that you prepare the goods properly for transport (secure packaging).
• Shipping costs are always paid by the sender (in case of the return the sender is Buyer), unless otherwise agreed in advance.
• If you are claiming under warranty, you will receive the repaired goods most quickly if you claim directly from the manufacturer or its authorised repairer.
